mendr Website Terms of Use
1. Introduction
mendr.com.au is a website designed to streamline the provision of repairs of commercial refrigeration and kitchen equipment by providing access to available Repair Technicians.
2. How to contract with mendr
By using the website, you enter into a contract with BevWizz Group Pty Limited trading as mendr (mendr). In order to be able to use the website, you are required to sign up for an account with mendr. When signing up, you are obligated to provide mendr with the location of your premises, telephone number and credit card data. On successful creation of your account, mendr will provide you with a corporate account, accessible for you with a password of your choice.
You must be 18 years of age or older to use the website. You represent that if you are an individual, you are of legal age to enter into a binding contract, or that if you are registering on behalf of a legal entity, that you are authorised to enter into, and bind the entity to, these Terms of Use.
3. Requests for Repair Technicians
Requests for repair services (Services) received by mendr are offered to Repair Technicians nearest to your premises. mendr does not perform services or repairs itself. mendr has no input into the availability of Repair Technicians at any time and cannot guarantee the availability of Repair Technicians to perform Services or the timeliness of any request.
4. Repair Instructions
Once a booking has been placed and payment has been approved, a Repair Technician will be assigned to the designated premises for the indicated time slot.
mendr shall use reasonable efforts to bring you into contact with a Service Technician in order to obtain the Services, subject to the availability of Service Technician in or around your location at the moment of your request for the repair services.
5. Payment
You agree that you will pay for all Services booked through the website and authorise mendr to charge your credit card account for all such Services in connection with your account. mendr shall charge a facilitation fee.
6. Services
You shall inspect the equipment on completion of the Services to ensure that they have been carried out in a workmanlike manner. If the Services are not carried out in a workmanlike manner you must make a claim within three (3) business days of completion via the website.
Any defective replacement spare parts will be repaired or re-supplied for a period of three (3) months after completion of the Services.
Failure to give notice within the agreed timeframe will be taken as acceptance that the Services performed were of acceptable standard.
7. Quality of Repairs
The quality of the Services requested through the use of this website is entirely the responsibility of the Repair Technician who ultimately provides such Services to you. mendr under no circumstance accepts liability in connection with and/or arising from the Services provided by the Repair Technician or any acts, actions, behaviour, conduct, and/or negligence on the part of the Repair Technician. Any complaints about the Services provided by the Repair Technician should therefore be submitted to the Repair Technician at first instance. If the Repair Technician does not investigate and remedy the Services mendr shall use reasonable efforts to bring you into contact with another Service Technician in order to obtain the proper Services, subject to the availability of Service Technician in or around your location.

mendr alone shall own all right, title and interest, including all related intellectual property rights, in and to the website. These Terms of Use do not convey to you any rights of ownership in or related to the website, or any intellectual property rights owned by mendr.

12. Modification
These Terms of Use are subject to change at any time by posting a notice on the website. Continued use of this website following a modification or revision of these Terms of Use implies acceptance of revision and will be taken as your agreement to be bound by them.
13. Applicable Law
The laws of the State of New South Wales and the Commonwealth of Australia govern the website and its Terms of Use and by entering in to this contract you are accepting the jurisdiction of the courts of the State of New South Wales in relation to any dispute or claim.
